Who Owns the Space Above the Building? Boundary Surveying for Air Rights

Cities eventually run out of ground and start selling sky. A developer buys the space above a rail yard, a tower rises over a low historic building or a garage sells the right to build on its roof. Each deal carves ownership out of empty air, and somebody has to define exactly where that ownership starts and stops. Boundary surveying for air rights is that work, and it asks surveyors to map property in three dimensions instead of two.
Treating Ownership as a Three-Dimensional Interest
Traditional parcels run on the flat. A deed describes a shape on the ground, and ownership extends upward and downward from it by default. Air rights break that habit. The interest being conveyed is a volume, bounded not just by horizontal lines but by vertical planes, stated elevations, structural envelopes or defined development zones.
The documents creating these interests read accordingly. A conveyance might grant everything above elevation 148 within a described footprint, or a volume between two floors of a structure, or a development envelope shaped around required clearances. The surveyor’s first task is understanding precisely which volume the words define, because every later measurement depends on that reading. A two-dimensional habit of mind misses half the boundary.
Connecting Vertical Rights to the Ground Parcel
No volume floats free. An air rights interest connects to the ground through base parcels, support easements, access routes and structural elements, and all of them have to live in one coordinate system before the interest makes sense.
The surveyor ties the base parcel boundary to the project control, then relates every dependent piece to it. The columns that will carry the new structure rise from the ground someone owns. The elevator and stair routes pass through space someone controls, and the easements granting support and access each describe geometry that has to close against the rest.
When the pieces come from different documents drawn in different eras, reconciling them into a single consistent framework is most of the work. A gap between the volume and its support rights is a gap in the project.
Establishing the Elevations That Control the Legal Volume
Horizontal boundaries have monuments. Vertical boundaries have datums, and datums demand the same rigor. An elevation written into a conveyance means nothing until the surveyor identifies which datum produced it, and old air rights documents regularly reference datums that differ from modern ones by measurable amounts.
Fieldwork then brings the numbers to life. The surveyor confirms benchmarks, verifies the datum relationship and measures the actual floor levels, structural surfaces and clearance planes the documents reference. Where a deed defines the volume’s floor as the upper surface of an existing deck, that surface gets measured directly rather than assumed from drawings. The stakes justify the care. A one-foot datum misunderstanding moves an entire ownership boundary one foot through someone’s building, and nobody discovers it until the steel arrives.
Documenting Support, Access, and Maintenance Relationships
A volume of air is only useful with a way in, a way to hold it up and a way to maintain what gets built. Those relationships are property interests of their own, and the survey has to document each one.
Support comes through columns, transfer structures and bearing walls that pass through the lower property, and their locations get surveyed precisely because the entire upper interest depends on them. Access comes through stairs, elevators, corridors and utility risers crossing space the air rights owner does not own, each backed by an easement whose geometry belongs on the survey.
Maintenance rights cover roofs, facades, mechanical platforms and drainage that one owner must reach through another’s property. Mapping these interests alongside the main volume shows the deal as it actually works, a bundle of connected rights rather than a floating box.
Communicating a Spatial Interest That a Flat Plat Cannot Fully Show
A standard plat looks straight down, and a three-dimensional interest defeats that view. Two ownerships stacked vertically occupy the same footprint, so a plan view alone shows one shape and hides the entire story. The deliverable has to work harder.
Sectional views carry most of the load, slicing through the property vertically so each interest appears at its true elevation with its bounding planes labeled. Elevation diagrams, coordinate tables listing the corners of each volume in three dimensions and careful descriptive notes fill in what the graphics cannot.
Attorneys drafting the documents, designers shaping the structure and owners signing the deal all need to see the same volume the same way, and the survey exhibits are where that shared understanding gets built. Done well, they make an invisible boundary legible. Done poorly, they leave a multimillion-dollar interest defined by guesswork, and the sky is an expensive place to guess.
